1. GENERAL PROVISIONS Serrese di Stefania Lo Muzio is a company registered in Italy (enrolled in the register of companies with REA number FG276345), with registered office in Viale della Repubblica 16, 71121 Foggia (FG), Italy (“ Serrese ”), offers for sale products of the collections distinguished by the Serrese brand (the " Products ") directly to its customers through this site www.serrese.it (the " Site "). The sale of Products on the Site is subject to the following terms and conditions of sale (the " Terms of Sale "). 2. CONSUMER INFORMATION 2.1. The Products on the Site are offered for sale only to consumer customers (" Customer "), the term Customer means any natural person who makes purchases for purposes unrelated to commercial, entrepreneurial, craft or professional activity. The purchase of the Products on the Site is permitted only to persons of legal age, over 18 years of age or other older age. The Products offered for sale on the Site can be purchased and shipped only in Italy. 2.2. Before confirming and sending a purchase order, the Customer must carefully read these Terms of Sale and accept them. These Conditions of Sale govern, together with the Privacy Policy, the contract between the Customer and Serrese as regards the sale of Products on the Site. 2.3. By submitting the purchase order, the Customer accepts and undertakes to observe these Conditions of Sale. If the Customer does not accept any of the conditions indicated in the Conditions of Sale, he must not send a purchase order for the Products on the Site. 3. PROCEDURE AND ORDER ACCEPTANCE 3.1. To purchase one or more Products, the Customer must select the Products of his interest, the size, color and type of heel. The Products selected for purchase will be added to the Cart. In order to have the possibility of keeping the items in the Shopping Cart in order to allow the continuation of the purchase at a later time, the Customer must first create an online account and register with said account at the time of purchase. It is possible to purchase without an online account/without registration, but all the items included in the Shopping Cart will be deleted if the purchase procedure is not completed and the Customer will be required to initiate a new purchase procedure when returning to the Site at a later time. 3.2. The Customer has the possibility to modify any information entered by the same during the purchase procedure until the moment in which he confirms his order. Once the order has been sent, it is no longer possible for the Customer to modify or cancel the order automatically. 3.3. The sales procedure will be considered completed only when the Customer sends the purchase order to Serrese by clicking on the "Place order" button at the end of the purchase confirmation page. To send the order, the Customer is required to provide his personal data, including name, address, email address and payment details. Furthermore, you will be required to tick the relevant box in order to confirm that you have accepted these Terms of Sale. Before sending the order, the Customer is advised to carefully review the summary of his order, including the details of the Products, the details of the shipping costs, the conditions required to exercise his right of withdrawal (the " Information on the of withdrawal ”, see point 7 below), the information on the legal guarantee and the Privacy Policy . 3.4. Following the sending of the order, Serrese will send the Customer an email to confirm receipt of the order by Serrese and its processing (the " Order Confirmation "). Customers will be able to access their orders at any time from the "Account" section on the Website, if they have registered to use the functionality on the Website, or by contacting Customer Service at info@serrese.it . Please note that the Order Confirmation constitutes acceptance by Serrese of the Customer's order. Serrese will accept the order and debit the sums due on the Customer's payment card immediately during the order processing phase. For payments by bank transfer, as soon as we receive the payment from the customer, the customer's Order will be processed. The customer has 10 days to pay by bank transfer, otherwise Serrese will proceed with the cancellation of the order. At this point Serrese will send the Customer a further confirmation email stating that the order has been accepted and will be in progress. 3.5. Serrese reserves the right not to accept orders placed by the Customer if it deems that they do not meet the requirements for sending a purchase order or those placed by subjects with whom there is an ongoing legal dispute relating to a previous order or for any other legitimate reason, without giving a reason. Serrese reserves the right not to accept and not to process orders that appear to have been submitted by traders and/or distributors. 3.6. For each Product offered for sale on the Site, one or more images of the Product will be displayed on the Site, together with the unit price, colors and sizes available. The images of the Products are provided purely and exclusively for illustrative purposes. The images and colors of the Products offered for sale on the Site may not correspond to the real ones due to the browser and/or monitor used or for other technical reasons. Serrese is not responsible for any inadequacy of the graphic representations of Products shown on the Site if due to the aforementioned technical reasons. 4. AVAILABILITY 4.1. Serrese undertakes to guarantee the availability of all the Products offered on the Site however, in exceptional cases, it could be possible that the Products sold by Serrese on the Site are not actually available. Serrese invites the Customer to check the availability of the Products offered for sale on the Site at the time of purchase, by calling the Customer Service at info@serrese.it . 4.2. If the Products ordered by the Customer are temporarily unavailable, Serrese will inform the Customer via email within the next working day after sending the order. 4.3. With regard to pre-orders or orders for Products with reduced availability, i.e. orders for an item not available at the time of the order but for which the date on which it will be available is clearly indicated on the Website, the Customer will receive a notice as soon as the order is shipped. In the exceptional cases where there is a delay in availability, the Customer will be contacted when the item becomes available again. 5. PRICE AND PAYMENT 5.1. The prices of the Products available for sale on the Site are expressed in Euros (€) for sales in Italy. 5.2. All prices of the Products to be delivered will be inclusive of VAT, but do not include any shipping costs which will be charged separately. Shipping costs depend on the destination and the type of delivery selected during the purchase process. Shipping costs and any other applicable taxes will be detailed on the payment page, in the Order Confirmation. 5.3. Serrese accepts payments by MasterCard, Visa, American Express, Bank Transfer and PayPal. 5.4. For payments via MasterCard, Visa, American Express and PayPal, the purchased Products will be sent to the Customer only after verifying the data relating to the Customer's payment card and only after receiving the debit authorization from the Customer's bank . Verification of payment card details may involve delays, but will be kept to a minimum and normally takes no more than 24 hours; however, there may be longer times. If payment by bank transfer has been selected, the Customer will receive an email with all the details and will have up to a maximum of 10 days to proceed with the payment. Otherwise we will proceed with the cancellation of the order. Once the payment is received, the order will be processed. 6. DELIVERY 6.1. The Products will be shipped to the address provided during the purchase process. For security reasons, Serrese does not ship any order to PO boxes nor does it accept any order where it is impossible to verify the identity of the recipient of the order and the address of the natural person. 6.2. All purchases will be delivered by the courier service selected by Serrese (“ Courier ”). Unless otherwise indicated for specific countries, from Monday to Friday excluding local or national holidays, after sending the Customer the Shipping Confirmation, based on the availability indicated. Saturday deliveries may be available if offered by the Courier. 6.3. The Products will be delivered within 2-3 (two-three) working days from the Shipping Confirmation, based on the shipping address and the country of destination of the Customer. For logistical reasons, shipments to the islands will take 3 to 5 working days. Serrese will not be responsible for unforeseen delays and/or delays exclusively attributable to the Courier. Before shipping the Customer's purchases, Serrese may need to confirm the Customer's details with the card issuer. Serrese undertakes to do its best to minimize delays considering that normally such operations do not require more than 24 hours. 6.4. In the event that the Customer does not receive the Products within 7-10 (seven-ten) working days from receipt of the Shipping Confirmation, the Customer is advised to contact Serrese on the telephone number (+39) 0881.235416. The Customer can also send an email to info@serrese.it . 7. RIGHT OF WITHDRAWAL 7.1. Customers have the right to withdraw from the purchase contract concluded with Serrese, without any penalty and without specifying the reason, within 10 (ten) days from the date of delivery of the products purchased on the Site. By exercising the right of withdrawal to Customers it is not permitted to exchange the purchased Product for another Product. 7.2. To exercise the right of withdrawal, customers are required to notify Serrese of their intention to withdraw from the contract by sending an email to info@serrese.it . The Customer must return the Products in their original "as new" condition to the Serrese point of sale (indicated below in point 7.8). All Products purchased online must be returned to the Serrese store. 7.3. The refund will be paid to the Customer on condition that the Products have not been used, washed and are in the same condition in which they were delivered, complete with all parts and accessories and in the original packaging. If the Customer exercises his right of return for all the Products included in the same purchase order, all the Products must be returned simultaneously with the same shipment. 7.4. Serrese reserves the right to check the returned Products and refuse the return of Products that it deems do not comply with the requirements indicated in point 7.3 above. 7.5. A full refund will be issued to the payment card used or to the current account used for the purchase as soon as possible and in any case within 14 (fourteen) days from the date on which Serrese first confirmed receipt of the returned Products sent by Customer, provided that the conditions mentioned in point 7.3 have been met. In any case, Serrese will refund as soon as the Customer has demonstrated that he has returned the Product. In the event that the Customer has expressly requested a more expensive type of delivery and different from the less expensive delivery method generally used proposed by Serrese, Serrese will be obliged to reimburse the delivery costs only up to the amount that the Customer would have paid if the Customer himself had accepted the less expensive and generally accepted delivery method proposed by Serrese. 7.6. If the returned Products were purchased as a gift, the refund will be paid to the person who made the payment. The payment date of the refund will be the same as the initial payment to Serrese. Therefore, the party that made the payment will not suffer any damage in terms of bank interest. 7.7. To return the Products to Serrese, Customers must contact the Courier to collect the Products they intend to return by Courier from the residence or domicile where the Products are located. The label for the return shipment must be affixed to the external side of the package. This can be requested by sending an email to the Courier who made the delivery. If the Courier is used to return the Products, all shipping costs, including the costs for returning the Products to Serrese, will be borne by Serrese. 7.8. If the Customer chooses not to use the Courier, Serrese recommends that the Customer insure the full value of the Product to be returned and obtain and carefully keep the shipping receipt and the relative number. In this case, the costs for returning the Products will be borne by the Customer and Serrese will not be responsible for refunding the price of the Products sent by the Customer which have not been received by Serrese following loss, theft or damage not attributable to Serrese. The Products must be returned to the following address: SERRESE Via delle Repubblica, 16 71121 Foggia (FG) Italy 8. CHANGES AND CORRECTIONS TO THE TERMS OF SALE 8.1. Serrese reserves the right to modify or correct these Conditions of Sale, the Privacy Policy, the Information on the Right of Withdrawal, the Products offered for sale on the Site and the prices of the Products, at any time and without notice to the Customer. Serrese invites the Customer to carefully check the Conditions of Sale and the Privacy Policy each time they use the Site to make a purchase. 8.2. Serrese will do its best to ensure that the prices and other information on the Products displayed on the Site are accurate and up-to-date. However, there may occasionally be printing errors, misstatements or omissions (“ Errors ”) relating to the description, pricing, promotions, offers and availability of the Products in question. Serrese reserves the right, at any time and without notice to the Customer, to correct Errors, to modify or update information, to revoke offers containing such Errors and to cancel any order at any time before shipment. 8.3. If the Customer's payment card is charged for a canceled order pursuant to point 8.2, the Customer will be informed immediately via email by Serrese (in any case no later than 24 hours from the cancellation of the order) and a refund will be issued to the card of payment by the Customer within 14 (fourteen) days from the cancellation of the order (the same will happen for payment by bank transfer). 8.4. All the modifications and/or corrections indicated above will apply exclusively to purchase orders sent after the date of the modification or correction implemented by Serrese. 9. COMPLIANCE OF ORDERS 9.1. The Customer must check the Products upon delivery to ensure that they correspond to those ordered. 9.2. Any anomaly identified at the time of delivery, including, but not limited to, any tampering or damage to the packaging, damage to the Products, missing items, non-compliant Products, defective Products, etc. (“ Defects ”), can be indicated by the Customer directly to the Courier by inserting a written and signed comment on the delivery notice provided by the Courier. In such circumstances, the Customer will not be required to accept the Products and may return them directly to the Courier. 9.3. If any Defects are identified after delivery, the Customer has the right to return the Products to Serrese following the procedure indicated in point 10 below. 10. LEGAL WARRANTY FOR NON-CONFORMING PRODUCTS 10.1. The Serrese Products offered for sale are covered by a legal guarantee of 6 months starting from the date on which the Customer receives the Products (“ Legal guarantee period ”). The Legal Warranty Period covers any defect and non-conformity of the Products. Without prejudice to any other remedy under applicable law if, during the Legal Warranty Period, a Product delivered to the Customer is found to be defective or does not conform to the Product ordered (“ Defective Product ”), the Customer has the right to return the defective Product to Serrese for a complete repair at no additional cost within a reasonable period of the request; if the complete repair is not an available remedy, Serrese can replace the defective Product with a new one within a reasonable period of the request. In any case, the Customer loses these rights if he does not report the lack of conformity to Serrese within two months from the date on which he discovered the defect. Furthermore, the Customer may request, at his choice, an appropriate price reduction or termination of the contract where one of the following conditions occurs:
  • (a) the repair and replacement of the defective Product is impossible or excessively expensive;
  • (b) Serrese has not repaired or replaced the defective Product within the reasonable time;
  • (c) the replacement or repair previously carried out by Serrese has caused considerable inconvenience to the Customer.
10.2. The return of defective Products for repair must be carried out in the following manner:
  • (a) Customers will be required to inform Serrese of any defect or non-conformity of the Products purchased within the Legal Warranty Period by writing to the following email address: info@serrese.it . The email must include details of the Product and a description of the defect.
  • (b) Serrese will take care of organizing the return of the Products with the Courier. The shipping costs and the insurance costs of the Products will be borne by Serrese.
10.3. If the Customer chooses not to use the Courier, Serrese will not be responsible for any loss of the Product. Serrese reserves the right to inspect the returned Products to verify the existence of the defect or non-conformity and can return the Products to the Customer if it deems that there is no defect or non-conformity. 11. REPAIRS It is not possible to request a repair on the Site for the Products purchased at points of sale or other shops that offer the Products for sale and vice versa (that is, it is not possible to request repairs at the shops or boutiques for the Products purchased on the Website). 12 RESPONSIBILITY OF SERRESE 12.1. The Products offered for sale on the Site are provided "based on availability". Without prejudice to the legal guarantee referred to in point 10.1 above, Serrese makes no guarantee, condition, undertaking or term, express or implied, under contract or otherwise, as to the condition, performance, satisfactory quality or fitness for a purpose of Products that goes beyond the Product description included in the purchase order, and all the aforementioned warranties, conditions, undertakings and terms of this nature are excluded to the fullest extent permitted by law. 12.2. Under no circumstances will Serrese be liable for damages of any kind, including but not limited to direct, indirect, incidental or consequential damages, possibly caused to the Customer and directly or indirectly deriving from:
  1. from the use or inability to use the Site by the Customer;
  2. from the reliance placed by the Customer on the information contained on the Site;
  3. from errors, service interruptions, deletions, damage or corruption of files and emails, software errors, viruses or defects, delays in operation or transmission, lack of communication, theft, destruction or unauthorized access to data, programs or services of Serrese.
12.3. Without prejudice to points 12.1 and 12.2, nothing in these Conditions of Sale will exclude or limit the liability of Serrese towards the Customer for fraud, death or personal injury caused by negligence, breach of terms pursuant to applicable legislation on consumer protection or any other liability which cannot be excluded or limited according to the applicable regulations. 13. APPLICABLE LAW AND JURISDICTION 13.1. These Conditions of Sale are governed in all their aspects by Italian law. For any dispute relating to the interpretation, execution and of these Conditions of Sale, the Court of the place where the Customer, as a consumer, has his residence will be competent 13.2. If any provision contained in these Terms of Sale is held to be invalid, void or unenforceable for any reason whatsoever, that provision will be deemed separate and will not affect the validity and enforceability of the other provisions. 14. CONTACTS 14.1. If the Customer intends to lodge a complaint or needs information or assistance relating to the Site or the purchase procedure, he can contact customer service at info@serrese.it . However, Serrese invites the Customer to contact customer care directly at the email address info@serrese.it to resolve any type of question directly.
